Article 1 - General BuildUp produces steel frame structures and provides services as an engineering office related to the production of steel frame structures.
Unless otherwise agreed in writing, the services of BuildUp are subject to the following general terms and conditions of sale, to the exclusion of all other conditions mentioned in documents provided by the buyer. Any request for our services implies acceptance of these general terms and conditions.
In the event of any contradiction between the following general terms and conditions and specific terms and conditions agreed in writing, the specific terms and conditions shall prevail.
The nullity of any provision of these general terms and conditions does not affect the validity of the remaining provisions. The fact that the buyer has not received our general terms and conditions in their native language does not exempt them from their application.
Article 2 – Quotation and Execution of the Project The assignment of BuildUp is determined in the quotation/order form that has been explicitly and formally accepted in writing by the customer.
Upon signing the quotation, the customer must transfer the advance payment to the communicated bank account.
The customer must then provide BuildUp with the most recent version of the plans. These plans should be adapted as much as possible to a steel frame structure, indicating the applied constructions and material thicknesses.
BuildUp translates the provided plans into a preliminary structural model of the steel frame structure. This model does not contain frames but the general outlines in which the frame structure will be conceived. All necessary additional information (constructions of walls, floors, and roofs) and calculation details (additional loads and boundary conditions) are displayed.
The customer is given the opportunity to review and amend the dimensions and comments on this preliminary structural model so that it can serve as a base document for the further progress of the project. The customer must return the approved version of this structural model, signed, to BuildUp, as they are solely responsible for the correct dimensions of this model and the material choices.
Any changes thereafter, resulting from customer-requested adjustments, will be charged as additional work.
The agreed delivery period starts once the signed quotation, the advance payment, and the signed structural drawings are in BuildUp’s possession.
The project at BuildUp starts with the engineering phase according to the applicable norms. BuildUp takes care of the engineering of all elements related to the steel frame structure and defines the final profile types and spacing. Any required hot-rolled steel beams and columns are also defined at this stage. These are not included in the quotation (or are merely indicative weights).
After validation of the necessary profile types during the engineering phase, the structural drawings are converted into detailed steel frame drawings. These digital drawings also generate files that drive the CNC-controlled roll forming machine.
If the customer has opted for assembled panels, the profiles will be mounted according to the assembly plan.
The buyer or their authorized representative (architect, engineering office, etc.) is solely and fully responsible for the accuracy of all data, plans, and specifications provided to BuildUp. BuildUp cannot be held liable for any deficiencies in execution resulting from incorrect information.
Additionally, the buyer or their representative is responsible for the architectural design, dimensions, and appearance of the drawn frames and/or goods. The buyer’s consulting engineer is solely responsible for the overall stability of the structure and all frames and/or goods that are part of the project, as well as for the connection principles, unless the stability study is conducted by BuildUp.
For the choice of cladding, energy performance (EPB), acoustics, fire resistance, and internal condensation, BuildUp only has an advisory role and has no performance obligation. BuildUp can in no way be held liable for the final results related to these aspects.
If BuildUp provides architectural details to the customer, these must be checked and validated by the customer, the customer's architect, and an expert in the field.
Hot-rolled steel is generally not included in the order. If a quantity is indicated, it is indicative and can only be confirmed after the stability study.
The customer explicitly accepts the following tolerance table: Length/width: +/- 3.0 mm per assembled panel. Diagonal: +/- 1.5mm/m1 per assembled panel
